NOTE: We do not wish to be added to the list of the top 100 gun shops in the US that have guns traced to a crime, therefore we reserve the right to refuse to sell a gun to anyone!

NOTICE!!!!   FEDERAL LAW states that…. YOU CANNOT PURCHASE A GUN(S) FOR ANOTHER PERSON!  GUNS MUST BE PICKED UP BY THE PERSON WHO IS BUYING AND WILL OWN THE GUN.

You must be 18 or older to purchase long guns and 21 or older to purchase hand guns. You do NOT need a “permit” to buy a gun. You do need a Indiana drivers license or other government photo ID. You must have a gun permit / conceal carry permit to carry a handgun CONCEALED ON YOUR PERSON in Indiana.

Gun Transfers:

We offer walk in person to person transfers, inbound and outbound out of state firearms transfers. All transfers require a Indiana drivers license or other government photo ID and a National Instant Criminal Background Check System (NICS) for inbound (buyers). In store “hand gun” sales to a NON-Indiana resident will have to be shipped to a licensed dealer in your home state. No sales where prohibited by law or to California, Maryland, Massachusetts, New York, New Jersey, Connecticut, or any other state that does not believe in The Second Amendment to the United States Constitution as part of the United States Bill of Rights that protects the right of the people to keep and bear arms. That was adopted on December 15, 1791, and In 2008 and 2010, the Supreme Court issued two Second Amendment decisions. Which ruled that the Second Amendment protects an individual’s right to possess a firearm, unconnected to service in a militia, and to use that arm for traditionally lawful purposes, such as self-defense within the home. Additionally, the Court ruled that the Second Amendment limits state and local governments to the same extent that it limits the federal government. Any how….  Please just check your local and state laws BEFORE buying.

We do not collect Indiana Sales tax on items transferred in from out of state. You are responsible for paying the 7% Indiana Sale Tax if required.

Transfers (which includes the background NICS check) are currently $20 per item for UPS and FedEx and up to $40 for US Mail. All guns MUST leave the store with a gun lock. (Federal Law). We will help you with your order since you CAN NOT order a firearm or accessories from one of “our distributors” on our license.  We just collect some information from you to get this process started and you can usually pick your item up in a couple of days.  All in bound transfers (buyers) require completed ATF form 4473 and a NICS check which we do when you pick up your purchase.

We do NOT provide copies of our FFL to the customer. If you buy a gun online (for instance, from John Doe’s Gun Shop), you’ll need to provide us with the dealer’s contact information, your (the purchaser) contact information, and a clear description or serial number of the gun you purchased. We contact that dealer and provide them with a copy of our FFL, then the dealer ships the gun or other items to us. We notify you when it arrives, and you can come pick it up when it’s convenient for you.  This normally takes just a couple of days.

Special Orders:

We deal with most of the large firearms distributors in the US. We are a High Volume “Gold” Dealer. If it is out there we can order it. You can order directly from our store or from our on line area. Find what you want, place a deposit, and pick it up in our store within a few days. We can check our REAL TIME online inventory 24/7/365 with multiple suppliers to find what you want.  Special order firearms will usually be in our store for pickup within 3 business days (excluding holidays, weekends etc).

Auctions:

We will buy items for sale on the major auction sites (like GunBroker.com) for customers for guns that are no longer available new. Auction items are available for pickup in our store. Transfer fees and rules apply.

“We” can NOT guarantee items “you” buy from the Internet or gun auctions….  WE DO NOT refund shipping fees on guns “you” buy and we are only doing the transfer on. All warranty issues must be handled directly with who you bought the firearm from or the firearm manufacturer. You must pay for return shipping if needed. Item(s) must be returned in original packing and in original condition with all parts and components.

Pay-Pal cannot be used for firearms or related items. E-Bay can not be used to buy or sell firearms.

We will ONLY ship to FFL’s. Have your dealer, email, or mail a signed copy of their FFL if buying, selling, or transferring guns through us.

Forms of Payment: (Green Cash Still Rules!)

We accept personal checks from residents of Morgan County, Indiana and may consider others on a case by case basis. We do accept cash, VISA, MASTERCARD and DISCOVER credit cards, add 3% to your purchase price for credit cards,  Money orders and cashiers checks may be held until they clear.

Martinsville Guns LLC  Consignment Agreement

Consignor agrees to place the items listed below on consignment with Martinsville Guns, LLC  to try to sell them under the terms of this agreement. Martinsville Guns, LLC agrees to accept the items listed for consignment sale under the terms of this agreement. Martinsville Guns, LLC provides the following services as part of the consignment service:

Cleaning/detailing of the Firearm if needed

Appraisal of the firearm to determine selling price if requested

Answering Questions from Potential Buyers

Licenses / Permits

Storage of Firearms.

Collection of Payment

Retention of All Documents Pertaining to Sale as Required by the BATF

When the items consigned are sold and final payment is made by the buyer, the Consignor will receive their net amount within 10 days. The Consignor represents that they are the rightful owner of the items listed, and that the items are free of any encumbrance. The Consignor agrees that, as Martinsville Guns, LLC is required to complete all inspections and specifications, prepare the items for sale, and advertise the items as needed, that the items consigned will be left on consignment with Martinsville Guns, LLC for a minimum of 30 days.

After 30 days, if not sold, consignor may pick up the firearms.  If firearm is not picked up within 90 days after agreement expires, the firearm becomes property of the Martinsville Guns, LLC. While this agreement is in effect, Consignor agrees to grant the exclusive right to market and sell the items listed below to the Martinsville Guns, LLC.

ALL ITEMS MUST BE IN GOOD CONDITION AND CLEAN: Consignee reserves the right not to display any consigned item found on close inspection to be defective.

LIABILITY: Consignor hereby releases Consignee to the fullest extent possible from any and all claims or any nature in connection with or arising from the placement of Consignor’s merchandise with Consignee. Consignor further covenants that he/she shall make no claim against Consignee or Consignee’s insurance carrier for any damage to Consignor’s merchandise.

If the Consignor decides to have consigned items returned, Federal Law requires that the Consignor complete all appropriate forms as if they were purchasing the firearms and pass the NICS background check.  If Consignor removes their gun(s) before the minimum 30 days, Consignor agrees to pay Martinsville Guns, LLC $15.00 for transfer fees (in addition to the consignment fee). If consignor fails the NICS check the firearm will be sold for the highest offer over the next 30 days and consignment fee retained from the sale and the balance paid to the consignor.

ATF Forms 4473:

A Firearms Transaction Record (Form 4473) must be completed for “each and every sale” or other transfer of a firearm to a non-licensee. This form must be completed when you:  Buy or trade for a firearm, get a firearm returned from a consignment, a returned pawned firearm, borrow use or rent a firearm for use off of our licensed premises; or otherwise transfer a firearm to a non-licensed person.

Note: We must transfer the firearm to the person who completed the Form 4473 and NOT to a spouse, relative, or other representative of that person. Indiana’s gun permit or license is NOT recognized by the ATF as a qualifying alternative to the background check requirement.

General Identification Requirements:

A proper “identification document” is:

A document containing the name, residence address, date of birth, and photograph of the person; Common examples of acceptable identification documents are a valid drivers license or a valid state identification card issued in lieu of a drivers license.

*** Prohibited Sales ***

We CAN NOT sell or transfer a firearm or ammunition to any of the following prohibited persons or in the following circumstances:
1. Straw Purchaser: A “straw purchaser” is a person who is not the “actual buyer” of the firearm; that is, a person who obtains a firearm for another person.

2. Person Under Indictment: A person “under indictment” includes any person who has been charged by indictment or information in any court with a crime for which he or she may be sentenced to a term of imprisonment exceeding 1 year.

3. Person Convicted of a Crime Punishable by Imprisonment for a Term Exceeding 1 Year:

4. Fugitive from Justice: A fugitive from justice is a person who has fled from any State to avoid prosecution for a crime (felony or misdemeanor).

5. Unlawful Drug User or Drug Addict:

6. Adjudicated Mental Defective or Person Involuntarily Committed to a Mental Institution:

7. Person Dishonorably Discharged from the Military:

8. Person Subject to a Restraining Order:

9. Person Convicted of a Misdemeanor Crime of Domestic Violence:
